This privacy policy relates to your use of the website www.brobizz.com, Brobizz A/S products and services and the Brobizz app.

This Privacy Policy explains how Brobizz A/S processes personal data in connection with the Customers and other natural persons’ use of Brobizz’ Products (Bizz transponders and/or Number Plate Payment), use of Brobizz’ digital platforms, including websites and the App, signing up for and sending direct marketing, sending service notifications, surveys and customer satisfaction surveys, Brobizz’ recording of telephone calls, maintaining blocked lists, and participation in competitions.

In this Privacy Policy, the term "Bizz transponder" is used as a common name for all types of actual transponders which can be used for the electronic collection of payment and which are part of Brobizz’ Product Portfolio.

At Brobizz.com, you can find a list of operators and business partners for which Brobizz' Products can be used.

2. Description of processing

2.1 Customer agreement with Brobizz on payment collection for Brobizz’s Products


Categories of personal data

Brobizz can process the following general personal data about the Customer when the Customer enters into a Customer Agreement on payment collection when using Brobizz’s Products:

Contact details (name, address, postcode, town/city, country, e-mail address and phone number), registration number of the associated vehicle, customer number, Bizz ID number, vehicle type, weight and environmental class of vehicle (if applicable), number of Products per Customer, payment card details, bank and account number and details of travel transactions when using the Product, including location data (driving times and driving location), if applicable.

Depending on the operators or partners with which the Customer uses the Bizz transmitter, the registration number of the vehicle that the Customer intends to use the Buzz transmitter with regularly will be processed.

When the Customer uses Number Plate Payment Agreement, Brobizz does not receive images of the Customer’s number plate from the operator or partner but receives only data confirming that Number Plate Payment Agreement has been used.

Brobizz also processes data on whether a Brobizz Customer has a Customer Relationship with an operator and/or partner and has entered into a separate agreement with an operator and/or partner.

As regards Brobizz’s business customers, the company name, CVR number and contact details of the contact person are also processed.

Purpose

Brobizz processes all of the above data for the general purpose of being able to administer and maintain the Customer Agreement with the Customer for the use of payment collection for transits and crossings with operators and partners and to deliver the agreed Products for the use of payment collection. The data for this purpose is collected directly from the Customer, and data that the Product has been used for transits and crossings with operators and partners is received from the relevant operator or partner.

Contact details, the bizz ID number of the Product and the personal data that may appear from an enquiry from the Customer or other physical person will also be processed for the purpose of answering and administering the enquiry. Data used for this purpose is collected directly from the Customer or the physical person who contacts Brobizz.

If the Customer expresses a wish to be contacted by Brobizz’s sales function, e.g. through an online contact form, the personal data will be processed for this purpose. Data for this purpose is collected directly from the Customer.

Where Brobizz processes data on whether a Brobizz Customer has a Customer Relationship with an operator or partner, the processing takes place for the purpose of assisting in the completion of e.g. a local agreement or other separate agreement which has been entered into directly by the Customer and the operator or partner e.g. in relation to assisting in concluding and administering a discount agreement with the operator or partner. The personal data used to administer and assist in this is collected directly from the Customer or the relevant operator or partner.

Where required by the operator or partner, the Customer’s personal data, such as the vehicle registration number associated with the Bizz transmitter, may be forwarded to the operator or partner for the purpose of charging the Customer correctly with regard to the Customer’s Agreement with either Brobizz, an operator or partner. This may take place in the event that the Bizz transmitter cannot be read, for example.

Personal data such as location data is used to carry out general analyses and statistics in order to support, improve and optimise operations in relation to payment collection and for the actual collection of payments.

Where the vehicle’s registration number is not collected directly from the Customer but from SKAT’s Vehicle Registry, the vehicle’s registration number is used for the purpose of administering and ensuring a correct and updated registration number for the vehicle that is linked to a Product.

Where Brobizz suspects, for example, that a Customer’s contact details are not up to date, such as when Brobizz has tried to send out physical or electronic mailings and these have been returned with a notification of an invalid address, Brobizz may collect information from other sources, such as CVR, an operator or a partner, for the purpose of administering and ensuring the accurate updating of the Customer’s contact details.

Legal basis

The legal basis for processing is the EU’s General Data Protection Regulation, article 6.1.b (necessary for the performance of a contract to which the Customer is party).

Insofar as replying to enquires from physical persons who are not customers is concerned and in relation to supporting and improving operations, the legal basis is the EU’s General Data Protection Regulation, article 6, paragraph 1, point f (legitimate interests), where Brobizz’s legitimate interests are to administer the enquiries and to support, improve and optimise operations as regards payment collection.

Storage

Brobizz will store personal data as long as necessary for the purposes stated above.

Personal data in relation to a Customer’s Customer Relationship is stored for the duration of the Customer Relationship and for a maximum of three (3) years after the end of the Contractual Relationship.

Enquiries received by Customer Services and their responses are stored for six (6) months and, where these relate to accounting data, for five (5) years plus the current year.

Personal data in connection with a lawsuit is stored for as long as the case is ongoing and for up to 10 years following its conclusion.

Data on the Customer’s travel transactions will be stored for five (5) years plus the current year in accordance with the requirements set out in the Danish Bookkeeping Act.

2.2 Brobizz digital platforms (Brobizz’s websites and app)


Categories of personal data

Brobizz may process the following general personal data on the Customer or other physical persons when they use Brobizz’s digital platforms:

Personal data, as indicated in section 2.1, the IP address of the device used, an indication that the Brobizz app has been downloaded and that it is linked to a Customer Agreement or Product, settings activated in the Brobizz app, the type of device that is using Brobizz’s digital platforms (e.g. computer, tablet or mobile phone) and general digital behaviour collected through cookies or other tracking technology on Brobizz websites, in the Brobizz app and on Brobizz’s social media pages.

Purpose

Brobizz processes the Customer’s personal data on the digital platforms for necessary, statistical, functional and marketing purposes, including to optimise the user experience of Brobizz’s digital platforms e.g. by giving the Customer an overview of the Customer’s account settings and other available services and features: in order to maintain Brobizz’s digital platforms; in order to target marketing, e.g. in connection with sending newsletters as mentioned in paragraph 2.3; and to optimise Brobizz’s Products. Part of the processing is done on the basis of the collection of cookies by Brobizz itself or via third-party cookies. Find out more about this in Brobizz’s cookie policy.

For targeted marketing purposes, Brobizz may compile personal data or carry out segmentation/profiling in order to make the marketing content relevant to the Customer or other physical persons on Brobizz’s digital platforms. See also section 2.3 for general information about Brobizz’s processing of data in connection with direct marketing.

If the Customer or other physical persons, through Brobizz’s app and/or in the settings of the device that has downloaded the app, have activated and allowed the app’s use of the device’s location and marketing consent has also been given to receive direct marketing from Brobizz, this data can be used to send marketing based on the location of nearby operators and partners, for example.

Section 2.4 also provides information on the extent to which Brobizz uses the app to send service messages.

The sources from which this personal data is collected for the above purposes are the Customer, Brobizz’s websites, Brobizz’s app and other online sources/websites to which third-party cookies have been added. You can find out more about this in Brobizz’s cookie policy.

Legal basis

The legal basis for processing is the EU’s General Data Protection Regulation, article 6, paragraph 1, point f (legitimate interest), where Brobizz’s legitimate interests are to optimise and maintain its digital platforms and Products and to target marketing.

Where the location data is used to send direct marketing, the legal basis for processing is the EU’s General Data Protection Regulation, article 6, paragraph 1, point a (consent). The Customer may withdraw their consent to processing at any time.

Storage

Brobizz stores the Customer’s personal data as long as necessary for the purposes stated.

Personal data in relation to a Customer’s Customer Relationship and digital behaviour in relation to this that is not based on the collection of cookies is stored as long as there is a Customer Relationship and for a maximum of three (3) years after the end of the Contractual Relationship with the Customer.

Personal data collected on the basis of cookies will be deleted in accordance with Brobizz’s cookie policy. View the cookie policy.

2.3 Direct marketing, such as newsletters


Categories of personal data

In connection with the registration and sending of direct marketing, Brobizz may process general personal data such as the Customer’s name, e-mail address, address and phone number, the Customer’s digital behaviour as specified in section 2.2 and the rate of opening newsletter emails. Brobizz also processes data if a Brobizz Customer has a Contractual Relationship with an operator or partner.

Purpose

Brobizz processes the Customer’s personal data in connection with signing up to receive direct marketing such as the receipt of newsletter emails or push notifications for the purpose of administering the Customer’s consent and sending the Customer the desired marketing material.

Brobizz also processes data on the Customer’s rate of opening sent newsletter mails for statistical purposes, including to make the content of the newsletter mails more relevant and targeted in future and to clean up the consent database. This personal data is collected directly from the Customer and through the newsletter emails sent to the Customer.

The Customer’s address, town/city and country, the digital behaviour specified in section 2.2, which provides an insight into areas of interest and focus, data on whether a Customer has a Customer Relationship with an operator or partner and when a Bizz or Number Plate Payment Agreement was last used can be used for the purpose of targeting the actual content of marketing and communication to the recipient. For this purpose, Brobizz can compile the personal data or perform segmentation/profiling. The personal data used for the above purposes is obtained from the Customer through cookies or from an operator or partner.

Legal basis

The legal basis for processing is the EU’s General Data Protection Regulation, article 6, paragraph 1, point f (legitimate interests), where Brobizz’s legitimate interests are to send relevant and targeted marketing to the recipient.

Storage

The personal data will be stored as long as marketing consent continues to apply and up to two (2) years after the Customer or recipient has withdrawn their consent to receive marketing, or until the Customer or recipient has not opened their newsletter emails over a longer period.

2.4. Service messages, questionnaires and satisfaction surveys


Categories of personal data

In connection with sending out service messages, questionnaires and satisfaction surveys, Brobizz processes general personal data about the Customer such as name, address, e-mail address, and phone number. In particular, Brobizz processes data about which settings the Customer has activated in the Brobizz app in relation to location data, number plate payment and type of vehicle for which the Customer has signed an agreement.

Purpose

The Customer’s contact details are processed for the purpose of contacting the Customer in connection with questionnaires, which are surveys for the purpose of investigating specific market conditions, satisfaction surveys for the purpose of optimising and supporting operations with input from the Customer’s response or service messages for the purpose of giving the Customer significant information about the Contractual Relationship with Brobizz, an operator or partner; e.g. a message about contact details must be updated.

Sending service messages, questionnaires and satisfaction surveys can, in contrast to marketing, take place without the consent of the recipient.

If the Customer has downloaded the Brobizz app and has activated receipt of e.g. push notifications from BroBizz on the device, Brobizz can use this digital channel for the purpose of sending. Similarly, Brobizz can use the Customer’s location, if this function is activated in the Brobizz app and/or in the settings of the device that has downloaded the app, for the purpose of sending relevant service messages based on location.

Legal basis

The legal basis for processing is the EU’s General Data Protection Regulation, article 6, paragraph 1, point f (legitimate interests), where Brobizz’s legitimate interests are to administer and support operations concerning the relationship with Brobizz’s Customers and to inform the Customer of significant conditions in relation to their Customer Agreement.

Storage period

Personal data in relation to service messages is stored as long as there is a Customer Relationship and for a maximum of three (3) years after the end of the Contractual Relationship. Questionnaires and satisfaction surveys are stored for as long as the relevant area to be surveyed remains active.

2.5. Recording of telephone calls


Categories of personal data

Brobizz processes the general personal data of a person who contacts Brobizz’s customer services by phone, such as their name, phone number and other general personal data that the enquiry may relate to, if the person has agreed that Brobizz may record the phone call.

Purpose

The purpose of the processing is documentation of possible agreements that have been entered into between the Customer and the employee.

Legal basis

The legal basis for processing is the EU’s General Data Protection Regulation, article 6, paragraph 1, point a (consent). The Customer may withdraw their consent to processing at any time.

Storage

Up to three (3) months from the time the call is recorded.

2.6 Keeping a list of blocked Bizz senders (blocked list)


Categories of personal data

Brobizz can process data about the Customer’s bizz ID number and vehicle registration number (if applicable) for the purpose of keeping a list of blocked Bizz senders.

The data used for the blocked list is collected from Customers, operators and partners.

Purpose

The purpose of the blocked list and the processing of the data is: i) to avoid the misuse of Bizz transmitters and vehicle registration numbers in the event of breach of agreement on the part of the customer (e.g. failed payment or failure to update necessary payment details etc.), ii) to avoid misuse of Bizz transmitters or vehicle registration numbers in the event of loss of either the Bizz transmitter and/or the vehicle and iii) to enable Brobizz to identify Bizz transmitters that have run out of battery or which lack other necessary updates (in order to inform the individual Customer about this).

Brobizz may register a bizz transmitter (and vehicle registration number if relevant) on the blocked list in the following instances:

  • If the Bizz transmitter and vehicle (if applicable) is reported stolen;
  • If the Customer loses the Bizz transmitter;
  • If the Customer Relationship has been terminated and the Bizz transmitter has been found to be involved;
  • If the Bizz transmitter and registration number are not linked to a valid payment card at the time of use, including when the payment card has expired (applies to customer relationships where payment normally takes place by payment card);
  • If the Customer has not maintained the agreed conditions for payment (applies to customer relationships where payment normally takes place by invoice);
  • If Brobizz has unsuccessfully requested that the Customer update a payment card or a registration number;
  • If the Bizz transmitter runs out of battery or where other technical requirements mean that the transmitter must be updated; and
  • If the Customer has provided incorrect, false or personal data that has not been updated for use in the collection of payment.

Legal basis

The legal basis for the processing of the above data is section 26, paragraph 1 of the Data Protection Act.

Disclosure of information

Brobizz forwards the data from the blocked list to operators or partners that are included in the EasyGo collaboration. Read more about the EasyGo collaboration, which is an association of operators here.

Storage

Brobizz stores the above data only for as long as it is necessary to satisfy the purposes that are described above, until the Bizz transmitter or customer agreement has expired.

2.7. Competitions


Categories of personal data

Brobizz processes the competitors’ general personal data such as name, address, phone number, e-mail address and marketing consent (if applicable) in connection with a competition entry.

Purpose

The processing takes place for the purpose of contacting the winner of the competition and in some cases for statistical purposes.

In some cases processing also takes place in order to send marketing to the entrant if the entrant has signed up for this in connection with the competition. Brobizz may also process the personal data to target marketing.

If an existing Customer takes part in a competition and enters their contact details, this may be used to ensure that the Customer’s contact details at Brobizz are maintained and kept up to date.

Legal basis

The legal basis for processing is the EU’s General Data Protection Regulation, article 6, paragraph 1, point f, where Brobizz’s legitimate interests are to contact the winner, perform statistics, send and target marketing and ensure correct and updated personal data.

Storage period

The contact details submitted by the entrants who have not won will be stored until the competition is over and the winner has received their prize.

The winner’s contact details will be stored for three (3) years, calculated from receipt of the prize. However, data which must be entered in accounts in relation to the winner’s prize award will be stored for five (5) years after the end of the financial year in which the prize is awarded.

The personal data submitted for the purpose of marketing will be stored as long as marketing consent continues to apply and up to two (2) years after the Customer or recipient has withdrawn their consent to receive marketing, or until the Customer or recipient has not opened their newsletter emails over a longer period.

For existing Customers, where their contact details have been updated, the contact details will be stored as long as there is a customer relationship and for a maximum of three (3) years after termination of the contractual agreement with the Customer.

3. Recipients of personal data (disclosure and transfer)

Brobizz passes on the Customer’s personal data only if this is a statutory requirement, only if this is necessary to fulfil an Agreement that Brobizz has entered into with the individual Customer, only to partners and operators or only if Brobizz has another legitimate interest in this. For example, it may be passed on to:

  • operators and partners in order to ensure correct administration, validation and updating of personal data for use in the collection of payments in sections 2.1 and 2.2 concerning third-party cookies and in relation to the blocked list as mentioned in section 2.6;
  • external suppliers to ensure the collection of outstanding payments, e.g. a debt collection company;
  • external suppliers and carriers in order to perform an agreed delivery of Products to the Customer, e.g. PostNord.

Brobizz also uses suppliers to whom the Customer’s personal data is transferred typically in connection with: the operation, development and hosting of, for example, communication and marketing solutions; the preparation of market analyses; and IT systems for processing business data. These suppliers are data processors for Brobizz and process personal data as instructed by Brobizz. Brobizz has entered into written data processor agreements with these data processors.

The data processors are subject to confidentiality agreements and may not use the personal data for purposes other than those specified in the data processor agreement.

4. Transfers to countries outside the EU/EEA

Brobizz transfers personal data to both data processors and sub-data processors established within and outside the EU/EEA. In cases where personal data is transferred to data processors and/or sub-data processors outside the EU/EEA, Brobizz ensures a legal transfer basis in accordance with the data protection legislation in force at any time. 5. The data subject’s rights in accordance with Article 3 of the EU General Data Protection Regulation

The Customer, or other physical persons whose personal data Brobizz processes, has the right to request to see it, to have it corrected or to have it deleted, as well as the right to oppose the processing of their personal data and have the processing of their personal data restricted.

If the processing of personal data is based on consent, the Customer or other physical persons from whom consent is obtained have the right to withdraw consent at any time. Withdrawal will be of no significance to the legality of processing undertaken before consent was withdrawn.

The Customer also has the right to receive personal data that they themselves have provided in a structured, commonly used and machine-readable format (data portability).

Conditions or restrictions may be attached to these rights. Therefore, there is no guarantee that the Customer has the right to data portability in a specific case, for example. This is dependent on the actual circumstances in connection with the processing activities. For example, it may not always be possible to comply with a deletion request if Brobizz has a legitimate reason to store the personal data.

The Customer or other physical persons about whom Brobizz processes personal data can exercise their rights by contacting persondata@brobizz.com and can always submit a complaint to a data protection supervisory authority, e.g. the Danish Data Protection Agency in Denmark.
