This privacy policy relates to your use of the website www.brobizz.com, Brobizz A/S products and services and the Brobizz app.

Brobizz A/S is keen to offer a clear and user-friendly website and app, with offers and information that are relevant to you.

To be able to do this, we use technologies that may collect, process and sort information about how you and other visitors use our website. This information is used primarily to improve user-friendliness, and also for editorial work on developing our website and app.
Information is provided below about the data that we collect, how we process it and who you can contact if you have any queries or comments on our guidelines.

This privacy policy explains how Brobizz A/S (“we” or “us”’) processes your personal data in connection with the provision of the website brobizz.com, your use of Brobizz A/S products and services and the Brobizz app.

We do not collect data that is not described in our privacy policy, nor do we collect data that can be attributed to you without notifying you about how you can avoid this.

2. Description of processing

Purpose #1 – Ordering and administration of your agreement with Brobizz A/S (Private/Business)

a) Provision of services in connection with your agreement with Brobizz A/S: Personal data is used with a view to administering your agreement with Brobizz A/S and the use of your transmitter/device or electronic payment collection (hereinafter “transmitter/device”). Brobizz A/S may also receive or share personal data about you with our partners when necessary for an agreement that you may have or are entering into with them.

We process the following categories of personal data on you:

a) General personal data:

Brobizz Private agreement:

  • Name*, postcode*, town/city*, country*, email*, telephone number, motor vehicle number plate, vehicle type, weight, environmental class (depending on which operator you are using the vehicle with), payment card information*, bank details and account number (where applicable), and information on usage history, including transactions using your transmitter/device, plus any information on the fact that you are a user of the Brobizz app or a customer of one of the Brobizz A/S partners.


Brobizz Business agreement:

  • All of the above information, plus company name*, CBR number * and contact person*.

    *= mandatory information that must be supplied by you when entering into the agreement.

  • Suppliers and resellers, including IT suppliers, support, product suppliers and financial institutions with which we cooperate in order to assist our business

Partners, when necessary in order to enter into an agreement with you

Storage

We will store personal data for as long as is necessary to fulfil the purposes stated.

  • Master data about you as a customer is stored as long as there is a customer relationship, and for a maximum of 3 years after the end of the contractual relationship.
  • Information on your transactions will be stored for 5 years plus the current year in accordance with the requirements set out in the Danish Bookkeeping Act.
  • Master data about you as a customer and information about your transactions in relation to your agreement with Brobizz A/S concerning use of a bizz for Europe transmitter will be stored for up to 5 years after termination of the agreement between Brobizz A/S and Telepass S.p.A.


Purpose #2 – Ordering and administration of your agreement with Brobizz A/S and use of number plate recognition

a) Provision of services in connection with your agreement with Brobizz A/S: Personal data is used with a view to administering your agreement with Brobizz A/S and the use of number plate recognition. We process the following categories of personal data on you:

a) General personal data:

  • Motor vehicle number plate*, name*, postcode*, town/city*, country*, email*, telephone number, vehicle type, weight, environmental class (depending on which operator you are using the vehicle with), payment card information*, bank details and account number (where applicable), and information on usage history, including transactions using your number plate recognition, plus any information on the fact that you are a user of the Brobizz app.
  • We do not store/accept photos of your number plate when you use number plate recognition, but merely information for billing purposes indicating that your number plate has been used.

Purpose #3 – Website and app optimisation and profiling and measurement of customer satisfaction

a) Optimisation of the user experience on the website and app: Personal data is collected when you use our website and app. We use this information for statistical purposes, and also to optimise the user experience on our website and app and for the services that we offer. For more details, please see our cookie policy.
b) Statistics and marketing: Personal data is used for statistics and marketing purposes, including targeting our communication with you on the basis of your interests and focus areas, and for sending you relevant marketing materials if you have given your consent for this. We may compile personal data or perform profiling in order to target our marketing. We also enhance your data with statistical data. If you have permitted access to your geographical location via the Brobizz app, information on your location will be used to show you which operators that we have partnerships with are in your vicinity.
c) Customer satisfaction surveys: Personal data is used in connection with customer satisfaction surveys. We use your data from time to time to forward satisfaction surveys with a view to improving our service and the general customer experience.

Basis for data processing

We process your data as described and on the following basis:

  • In accordance with GDPR article 6.1.f (necessary for the pursuance of Brobizz A/S’ legitimate interests), including:

    - Marketing purposes and statistics

    - Website and app optimisation

    - Surveying customer satisfaction in order to improve our services

  • Processing of location-based data (geographical location) is based on your permission, which you give us by enabling location-based information in the app. You can withdraw your consent to our processing of your location-based data at any time by disabling this function on your device (e.g. mobile phone, tablet and/or computer).

Suppliers, including IT suppliers with which we cooperate in connection with optimisation of your user experience, including in connection with ordering or other transfer of website and app content.

We will store personal data for as long as is necessary to fulfil the purposes stated.

Purpose #4 – Signing up for the newsletter

Personal data is used for marketing purposes, including targeting our communication with you on the basis of your interests and focus areas, including sending out newsletters.

  • GDPR article 6.1.b (necessary for the fulfilling of a contract to which the data subject is party).

Storage

We will store personal data for as long as is necessary to fulfil the purposes stated.

  • Up to six months from the date of the last response to the inquiry.
  • Inquiries regarding your agreement with Brobizz will be deleted no later than three years after the end of your customer relationship with us.
  • Inquiries regarding payment disputes will be stored for five years plus the current year in accordance with the requirements set out in the Danish Bookkeeping Act.

Purpose #6 – Assistance for you via a partner with which you have an agreement

Brobizz A/S’ processing of your data in accordance with the Brobizz A/S agreement with a partner with which you have a customer agreement (customers that have a customer agreement with Telepass S.p.A, UTA, FDE, Trafineo).

a) For fulfilment of an agreement between Brobizz A/S and a partner with which you have a customer agreement concerning electronic payment collection, Brobizz A/S processes your personal data when you use electronic payment collection in Scandinavia and, in some cases, selected areas in Europe: Personal data is used with a view to collecting and passing on your personal data to the partner so that you can be charged correctly pursuant to your agreement with the partner when using the selected electronic payment collection solution.

b) For fulfilment of an agreement between Brobizz A/S and a partner with which you have a customer agreement concerning electronic payment collection, Brobizz A/S processes your personal data when assisting with entering into discount agreements on your behalf with selected operators.

  • Information on usage history, including transactions using electronic payment collection in Scandinavia and, in some cases, selected areas in Europe.

Re. b) General business and personal data:

  • Company name*, CBR number *, contact person*, postcode*, town/city*, country*, email* and telephone number, motor vehicle number plate, vehicle type, weight, environmental class, identification number of your transmitter/device (depending on the operator with which you use the vehicle).

  • Brobizz A/S’ partners with which you have an agreement concerning use of the selected electronic payment collection solution

Re. a): Information on your transactions will be stored for 5 years plus the current year in accordance with the requirements set out in the Danish Bookkeeping Act.

Re. b): Personal data about you as a customer is stored as long as there is a customer relationship, and for a maximum of 3 years after the end of the contractual relationship.

Purpose #7 Brobizz pages on social media

Brobizz has a fan page or a business page on social media which you may visit and use. Brobizz and the relevant social media page are joint data controllers for the collection of personal data about you when you visit our pages on social media.

Brobizz also processes data about you which you send to Brobizz, for example in connection with a direct inquiry that you send to us via one of the above platforms. These data will typically constitute your name and the question you are submitting to us.

  • GDPR article 6(1)(f) (Necessary for the pursuit of Brobizz’s legitimate interests, namely the identification of users of Brobizz’s pages on social media and communication with said users).

We may share your personal data with:

  • Suppliers including IT suppliers and media agencies with which we collaborate in connection with our communications with you and with our identification of you as a user of the pages.

Storage

Brobizz does not store and does not have access to the information about your online behaviour which is collected by Facebook. These details are stored by Facebook as described in Facebook’s privacy policy.

Brobizz neither stores nor has access to the information about your online behaviour which is collected by LinkedIn. These details are stored by LinkedIn as described in LinkedIn’s privacy policy.

We will store personal data for as long as is necessary to fulfil the purposes stated.

  • Up to six months from the date of the last response to the inquiry.
  • Inquiries regarding your agreement with Brobizz will be deleted no later than three years after the end of your customer relationship with us.
  • Inquiries regarding payment disputes will be stored for five years plus the current year in accordance with the requirements set out in the Danish Bookkeeping Act.

Purpose #8 – Recording of telephone calls

The recording of telephone inquiries to Brobizz Customer Service for purposes of training and quality assurance.

We will store personal data as long as necessary for the purposes stated:

  • Up to three months from the time at which your call is recorded.

Objective #9 – Maintaining a blacklist of blocked transmitters (blocked list)

In pursuance of Section 26 (1), no. 1 of the Data Protection Act, the Danish Data Protection Agency has granted Brobizz A/S permission to compile a ’blocked list’ to avoid abuse of transmitters (e.g. the bizz® transmitter), or a vehicle’s registration number in the event of a breach of contract on your part as a Brobizz customer, and to protect against abuse if a transmitter is lost or stolen.

Brobizz will register a transmitter (and vehicle registration number if relevant) on the list in the following instances:

  • When a transmitter or vehicle is reported stolen, or if a transmitter is lost by the customer, when the contract is terminated and the transmitter is to be returned.
  • In the event of payment by payment card, the transmitter and/or registration number will be entered on the blocked list if no payment card is linked to payment for a transmitter or registration number at the time the transmitter is used.
  • When the customer’s payment card has expired.
  • When paying by invoice, the transmitter and/or registration number will be entered on the blocked list when the contractual conditions are not fulfilled.


Brobizz will inform you if you are subject to one of the above. Brobizz can enter you on the blocked list if you fail to react, including (for instance) failure to update a payment card or registration number.

You can also be entered on the list immediately if there are special circumstances, especially any suspicion of abuse of the transmitter.

Recipients

We may share your personal data with:

  • The EasyGo partnership, a consortium of operators. Find out more about this at https://easygo.com/. If entered on the blocked list, your details will be shared with operators who are members of the EasyGo partnership.

Storage

We will store personal data as long as necessary for the purposes stated:

  • Data is deleted when the transmitter is terminated, returned or confiscated, or the customer no longer wants to use number plate recognition.

3. Transfers to countries outside the EU/EEA

In special cases, we may transfer your personal data to countries outside the EU/EEA (USA and Canada). Transfer to the third countries will only take place for specific purposes as referred to in section 2, and we will always ensure that the necessary guarantees are in place when a transfer takes place to a country outside the EU/EEA.

These transfers will take place pursuant to the Privacy Shield scheme entered into between Europe and the USA. Transfer to Canada will take place pursuant to the Commission’s end of contracts is published by the Commission, or in respect of other contracts approved by competent authorities. 4. Compulsory information

The information marked * is mandatory. An agreement cannot be set up with Brobizz A/S unless you give this information.

5. Your rights

You have the following rights:

  • You have the right to ask to view, correct or delete your personal data. If you wish to amend specified card details, this can be done via the Brobizz website or in our app.
  • You also have the right to oppose the processing of your personal data and to have the processing of your personal data limited.
  • In particular, you have an unconditional right to oppose the processing of your personal data for direct marketing purposes.
  • If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time. Your withdrawal will be of no significance to the legality of processing undertaken before your consent was withdrawn.
  • You have the right to receive the personal data that you yourself have provided in a structured, commonly used and machine-readable format (data portability).
  • You can always submit a complaint to a data protection supervisory authority such as the Danish Data Protection Agency.

Conditions or restrictions may be attached to these rights. Therefore, there is no guarantee that you have the right to data portability in a specific case, for example – this is dependent on the actual circumstances in connection with the processing activities.
